Abstract

This Paper outlines the criminalization of participation in an organized criminal group under Article 5 of the Organized Crime Convention. It explores the development and rationale of this Article, identifies and explains the elements of the offences set out in Article 5, and discusses issues and challenges in the implementation and application of these offences in the domestic laws of States Parties.
